The record does not support the Bankruptcy Court's conclusion that
debtor's delay in closing its bankruptcy case "resulted" from
circumstances sufficiently extraordinary to justify the rare and
powerful relief of retroactive closure. Granting a nunc pro tunc order,
which relieved the debtor of the obligation to pay statutory bankruptcy
trustee fees, was thus an abuse of discretion.

Income tax forms unjustifiably filed years late, where the IRS has
already prepared substitute returns and assessed taxes, do not
constitute "returns" for purposes of Bankruptcy Code section
523(a)(1)(B)(i). Accordingly, the debtor's tax liabilities were not
dischargeable in bankruptcy.

Because oil discharged from defendants' facility spilled into waters
adjacent to an open body of navigable water, it contaminated waters
regulated by the federal government under the Oil Pollution Act,
triggering federal regulatory jurisdiction pursuant to that Act.

IN RE HOMEOWNERS MORTGAGE AND EQUITY, INC. (12/17/03 - No. 02-50954)
Bankruptcy court correctly decided that Fannie Mae was entitled to a
claim on the bankruptcy estate despite the fact that Fannie Mae had
already unilaterally terminated its contract with the debtor. The loan
repurchase obligations triggered by debtor's breach of warranty survived
the termination of the contract itself.

BROOKOVER v. BODENSTEIN (12/19/03 - No. 02-3237)
The United States Trustee has congressionally conferred authority,
pursuant to 28 U.S.C. section 586(b), to accept the voluntary
resignation of a bankruptcy trustee in a pending case, and the law does
not require the decision to be submitted to the bankruptcy court for
approval.
